Hardiman Deputy Director of Communications Massachusetts Office of Consumer Affairs & Business Regulation 501 Boylston Street, Suite 5100 Boston, MA 02116 Dear Ms. Hardiman: I have received the petition of Colman Herman appealing the nonresponse of the Office of Consumer Affairs and Business Regulation (Office) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Herman requested "hard copies and electronic copies of any and all communications ... " related to an inquiry placed on or about June 24, 2019. Claiming to not yet have received a substantive response, Mr. Herman petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Office intends on providing a written response to Mr. Herman. Accordingly, the Office is ordered to provide Mr. Herman with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the Office's response within ninety days. See 950 C.M.R. 32.08(1).
