Murray Supervisor ofR ecords July 17, 2019 SPR19/1386 Thomas Guerino Town Administrator Town of Bourne 24 Perry A venue Buzzard's Bay, MA 02532 Dear Mr. Guerino: I have received the petition of James Kinsella of the Enterprise Newspaper appealing the response of the Town of Bourne (Town) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Kinsella requested a copy of the Town Administrator's annual performance review for fiscal year 2019. Unsatisfied with the latest response he received from the Town, Mr. Kinsella petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Town intends on proving a subsequent response to Mr. Kinsella. Accordingly, the Town is ordered to provide Mr. Kinsella with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Kinsella may appeal the substantive nature of the Town's response within ninety days. See 950 C.M.R. 32.08(1).
