Murray Supervisor of Records July 16, 2019 SPR19/1392 Thomas Fowler Chief of Police Salisbury Police Department 181 Beach Road Salisbury, MA 01952 Dear Chief Fowler: I have received the petition of Kurt Niziak appealing the response of the Salisbury Police Depa1iment (Depaiiment) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Niziak requested "clearance rates for cases in years 2016, 2017 and 2018." Unsatisfied with the Depaiiment's response in which they claimed they are not in possession of any responsive records, Mr. Niziak petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department intends on proving a supplemental written response to Mr. Niziak. Accordingly, the Depaiiment is ordered to provide Mr. Niziak with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Niziak may appeal the substantive nature of the Depaiiment's response within ninety days. See 950 C.M.R. 32.08(1).
