Murray Superv;sor of Records July 17, 2019 SPR19/1412 Kyle Wiley Records Access Officer Town of Marblehead 188 Washington Street Marblehead, MA 01945 Dear Ms. Wiley: I have received the petition of Elizabeth Garthe appealing the response of the Town of Marblehead (Town) to a request for public records. G. L. c. 66, § JOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Garthe requested several categories ofrecords within the possession of the Town concerning "the Gover Landing Condominium Trust." Unsatisfied with the Town's response in which she notes that she suspects that there are more records in existence that she has not yet been provided, Ms. Garthe petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Town intends on proving a supplemental written response to Ms. Garthe aimed at addressing the itemized concerns outlined in her appeal. Accordingly, the Town is ordered to provide Ms. Garthe with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Garthe may appeal the substantive nature of the Town's response within ninety days.
