General Counsel Executive Office of Housing & Economic Development One Ashburton Place, 21st Floor Boston, MA 02114 Dear Attorney Cosco: I have received the petition of Kyle Clauss of Boston Magazine appealing the nonresponse of the Executive Office of Housing & Economic Development (EOHED) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Clauss requested "[a]ny and all documents, including written and electronic communications, related to the April 25, 2018 'commitment for Commonwealth Funding Amazon Expansion, Seapmi Square, Boston."' Claiming to not yet have received a response, Mr. Clauss petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the EOHED intends on providing a written response to Mr. Rocheleau, as well as any responsive records within their possession. Accordingly, the EOHED is ordered to provide Mr. Clauss with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Clauss may appeal the substantive nature of the EOHED's response within ninety days.
