G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Clauss requested "any and all documents ... related to infrastructure improvements tied to the Seaport Square Parcel LF project, from Jan. 1, 2019 until Jan. 1, 2019." Mr. Clauss then narrowed the scope of his request on June 12, 2019. Claiming to have not yet received any records, Mr. Clauss petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Agency intends on proving a written response to Mr. Clauss as well as any responsive records within their possession. Accordingly, the Agency is ordered to provide Mr. Clauss with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Clauss may appeal the substantive nature of the Agency's response within ninety days. See 950 C.M.R. 32.08(1).
