G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Clauss requested records related to "transportation infrastrncture improvements with the Seaport Square Parcel L4 project. .. " Claiming to not yet have received a response, Mr. Clauss petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative working in tandem with MassDOT is working to compile requested records and plans on providing Mr. Clauss with a written response. Accordingly, MassDOT is ordered to provide Mr. Clauss with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Clauss may appeal the substantive nature ofMassDOT's response within ninety days.
