Box 1969 Pittsfield, MA 01202 Dear Attorney Kempthorne: I have received the petition of Paul Revells appealing the nonresponse of Berkshire District Attorney’s Office (DAO) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Revells requested legal records including: any and all police reports, incident reports, the list of exhibits presented at trial, and any laboratory test results and examining reports relating to evidence tested in his case. | Subsequent to the intervention by a member of the Public Records Division, I learned that the DAO provided Mr. Revells a response to his request on July 25, 2019. Accordingly, I will now consider this administrative appeal closed. Mr. Revells may appeal the substantive nature of the Division response within ninety days. See 950 C.M.R. 32.08(1).
