Counsel Depmiment of Housing & Community Development 100 Cambridge Street, Suite 300 Boston, MA 02114 Dear Attorney Walleigh: I have received the petition of Daniel Schneider appealing the nonresponse of the Depmiment of Housing & Community Development (Depa1iment) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Attorney Schneider requested "information about families living in DHCD's shelter program, known was Emergency Assistance, or EA." Claiming to not yet have received responsive records, Attorney Schneider petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Depmiment intends on proving a supplemental written response to Attorney Schneider aimed at addressing the concern outlined in his appeal, as well as any responsive record(s) within the Depmiment's possession. Accordingly, the Depmiment is ordered to provide Attorney Schneider with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Sclmeider may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, ~ Rebecca S.
