Assistant City Solicitor City of Lowell Law Department 375 Merrimack Street, 3rd Floor Lowell, MA 01852 Dear Attorney Hucksam: I have received the petition of Laura Ortiz appealing the response of the City of Lowell Law Depaiiment (City) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, on June 1, 2019, Ms. Ortiz requested "access to EOY 2018-2019 Rep01i" and "a copy of the Building Staff Profiles (School Nurses) for the 2018-2019 school years at every Lowell Public School Districts individual schools." The City responded on July 30, 2019 denying access to the report. Unsatisfied with the City's response, Ms. Ortiz petitioned this office and SPRl 9/1540 was opened as a result. Subsequent to opening this appeal, the City provided a response to Ms. 01iiz on August 8, 2019. The City indicated "[i]n regard to the EOY Rep01i for the 2018-2019 school year, the EOY Rep01i will not be completed until after October 1, 2019. Therefore, no such document exists at this time." The City also provided "[i]n regard to the Building Staff Profiles (School Nurses), on July 30, 2019 you were provided with a copy ... updated as of 6/17/2019, which includes information concerning the staffing of each school by school nurses. We have attached hereto a copy ... updated as of 10/25/2018."
