Medeiros Records Access Officer Dartmouth Police Department 249 Russells Mills Rd Dartmouth, MA 02748 Dear Ms. Madeiros: I have received the petition of Andrew Quemere appealing the response of the Dmimouth Police Department (Department) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Quemere requested copies of any contract(s) and advertisement material concerning fentanyl contamination within the Depmiment's possession. Unsatisfied with the Department's response in which they claimed they are not in possession of any responsive records, Mr. Quemere petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Depmiment intends on proving a subsequent written response to Mr. Quemere aimed at addressing the concerns outlined in his appeal. Accordingly, the Depmiment is ordered to provide Mr. Quemere with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Quemere may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1).
