The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor ofR ecords · August 12, 2019 SPR19/1629 Mary Ellen Normen Deputy Superintendent of Administration & Finance Brookline Public Schools 333 Washington Street Brookline, MA 02445 Dear Ms. Nonnen: I have received the petition of Michael Offner appealing the response of the Town of Brookline (Town) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Offner requested several categories ofrecords within the possession of the Town. Unsatisfied with the Town's response in which he believes the Town wishes to assess fees, Mr. Offner petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Town provided a supplemental response to Mr. Offner sent on August 12, 2019 in which they specifically note tha:t "the Town will be waiving any fees related to this request and providing documents as they become available ... " Whereas the basis of this appeal was opened as a result of the Town's possible assessment of fees, I will now consider this administrative appeal closed. Mr. Offner may appeal the substantive nature of the Town's response within ninety days. See 950 C.M:R. 32.08(1). Sincerely, ~~ Rebecca S.
