Guerin Records Access Officer Division of Capital Asset Management & Maintenance One Ashburton Place, 15th Floor Boston, MA 02108 Dear Mr. Guerin: I have received the petition of Gregory Y anchenko appealing the nonresponse of the Division of Capital Management and Maintenance (Division) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Yanchenko requested records related to a specifically identified project. Having received no response, he petitioned this office. Please note this request was the subject of a petition submitted by the Division. See SPR19/1565 Determination of the Supervisor of Records (August 12, 2019). Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten business days ofreceipt of the request. G. L. c. 66, § lO(a)-(b). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L. c. 66, § 1O (b ). All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. · Subsequent to the intervention by a member of the Public Records Division, this office was notified that a response was provided, dated August 23, 2019. Whereas this matter was opened based upon the Division's failure to provide a written response, I will now consider this administrative appeal closed. I understand Mr. Yanchenko appealed the Division's August 23rd response and SPR19/1730 was opened as a result.
