Records Access Officer Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 3910 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Colman Herman appealing the nonresponse of the Massachusetts Bay Transportation Authority (Authority) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Herman requested hard and electronic copies of all communications in identified employee files related to the video of the Red Line train derailment on June 11, 2019. Having received no response, he petitioned this office. Subsequent to the intervention by a member of the Public Records Division, this office was notified that a response was provided, dated August 14, 2019. Whereas this matter was opened based upon the Authority's lack of a written respopse, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Authority's response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, ~~ Rebecca S.
