September 12, 2019 SPR19/1768 Stacy Book Records Access Officer Massachusetts Parole Board 12 Mercer Road Natick, MA 01760 Dear Ms. Book: I have received the petition of William Nadworny appealing the response of the Massachusetts Parole Board (Board) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Nadworny requested "video/audio recording of the viewing of the Parole Board members of the May 12, 2015, Public Parole hearing of William Nadworny." The Board responded by providing responsive records. Claiming to not have received all records responsive to this request, Mr. Nadworny petitioned this office and SPR19/1768 was opened as a result. In Mr. Nadworny's appeal he states the Board's response includes "one (1) DVD of the Requestor's 2015 Parole Hearing that only views the Requestor and his counsel, but did not view the members questioning the Requestor." Mr. Nadworny requests the Board "[p]rovide the DVD of the video recording of the Board Members of the requestor's 2105 parole hearing, or inform the Requestor that the agency did not record the Parole Board members ... and furnish the Requestor the regulation and/or procedure that allows the Board Members to be independently filmed at Public Parole hearings ... " Subsequent to the intervention by a staff member of this Division, I learned that the Board is willing to provide Mr. Nadworny with a supplemental response to his request confinning whether it possesses additional responsive records.
