Murray Supervisor ofR ecords September 11, 2019 SPR19/1772 Susan Audette Town of Amherst Town Hall 4 Boltwood Avenue Amherst, MA O1 002 Dear Ms. Audette: I have received the petition of Chrissy Ryan appealing the response of the Town of Amherst (Town) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Ryan requested "[a]ll financial documents related to the Public Educational Government (PEG) funds for the last 2 years." The Town responded by providing responsive records. Claiming to not have received all records responsive to this request, Ms. Ryan petitioned this office and SPR19/1772 was opened as a result. In Ms. Ryan's appeal she states the Town's response "is not in fulfillment of the Public Records Request and does not reflect 'all financial documents' as it is a PDF that selects some information and omits the total amount paid to the town from the bale bills, the total balance of the PEG account." Subsequent to the intervention by a staff member of this Division, I learned that the Town is willing to provide Ms. Ryan with a supplemental response to her request for records confirming whether it possesses additional responsive records. Accordingly, the Town is ordered to provide Ms. Ryan with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations without delay. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
