Director of Public Records City of Boston 1 City Hall Plaza, Room 615 Boston, MA 02201 Dear Attorney Williams: I have received the petitions of Pat Bender appealing the responses of the Boston Police Department (Department) to a request for public records. G. L. c. 66, § IOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Bender requested records pertaining to the Department's "daily log" within a certain range of dates. Unsatisfied with the Department's responses, and claiming that they are not in compliance with state law, Mr. Bender petitioned this office and these appeals were opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I a learned that representative from the City of Boston (City) intends on proving a supplemental written response on behalf of the Department to Mr. Bender aimed at addressing the concem(s) outlined in his appeals. Accordingly, the City is ordered to provide Mr. Bender with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of any response to this office at pre@sec.state.ma.us. Mr. Bender may appeal the substantive nature of the City's response within ninety days.
