Dear Attorney Williams,

I have received the petition of Robert Aldrich appealing the nonresponse of the Boston Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.MLR. 32.08(1). Specifically, Mr. Aldrich requested records related to certain junk dealer information.

Under the Public Records Law and the Access Regulations (Regulations) all requests for - public records must be met with a response within 10 business days of receipt of the request. G. L. c, 66, § 10(a)-(b). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L, c. 66, § 10(b). All records custodians must comply with both the Public Records Law and the Regulations with respect to the: timeliness of response.

As of the date of this letter, it is my understanding that the Departmen has not provided Mr. Aldrich a response to his request for records,

Order Accordingly, the Department is ordered to provide Mr. Aldrich with a response to the request, provided in a manner consistent with this order, the, Public Records Law, and its

Regulations without delay. A copy of any such response must be provided to this office, It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.

Also, please note that a BP D Public Records Officer sent me a letter dated July 9, 2019, in response to my July 1 and 2, 2019, letters. However, it was simply notification that stating, in part, "Twle are currently reviewing your request to determine if public records exist. See enclosed’ copy of BPD letter.

That BPD letter dated July 9, 2019, was sent to me nearly two months ago.

Thé:BPD made no effort to respond to my..6/12 and 6/27 public request letters. regardity Therefore, please initiate the appeal process request BPD' s refusal or rather non response to my public records requests.
