Brendemuehl Appeals Unit Office of the Suffolk County District Attorney One Bulfinch Place Boston, MA 02114 Dear Mrs. Brendemuehl: I have received the petition of Justin D. Powers of The Commonwealth ofM assachusetts Committee for Public Counsel Services appealing the nonresponse of the Suffolk County District Attorney's Office to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Powers requested records related to an investigation of an incident involving Richard J. Sinnott III at Boston City Hall Plaza that occurred on or around the 1i h of September, 1980. Claiming to not yet have received a response, Mr. Powers petitioned this office and this appeal was opened as a result Subsequent to the intervention by a staff member of the Public Records Division, I 2ot'\ learned that the Office responded to Mr. Powers' request with a response sent on September 2019. The Office responded, "We are currently completing a diligent search through our employment records. We expect this will take approximately one to two weeks to complete this search". Whereas the basis of this appeal was opened as a result of the Office's failure to provide a written response, the Office is ordered to provide Mr. Powers with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Powers may appeal the substantive nature of the Office's response within ninety days.
