Miyares and Harrington LLP 40 Grove Street, Suite 190 Wellesley, MA 02482 Dear Attorney Fried: I have received your petition on behalf of the Town of Wellesley School Department (Department) seeking permission to charge $39.18 per hour in responding to a request made by Ronald Alexander. G. L. c. 66, § lO(c), (d)(iv). As required by law, the Depaiiment furnished a copy of their petition to the requestor. Id. On September 13, 2019, Mr. Alexander requested "to inspect the set of 'randomly selected records' that were provided to the Supervisor of Reocrds for review on August 14, 2019." Previous fee petitions and appeals The requested records were.the subject of previous fee and time petitions and subsequent appeals. See SPR19/l 122 Determination of the Supervisor of Records (June 11, 2019); SPR19/l 185 Determination of the Supervisor of Records (June 27, 2019); SPR19/1350 Determination of the Supervisor of Records (July 12, 2019); and SPR19/1459 Determination of the Supervisor of Records (September 13, 2019). In my July 12, 2019 determination I found the School may assess a fee for the time spent to segregate and redact these requested records at $39.18 per hour, the School provided a fee estimate dated July 15, 2019. Unsatisfied with the School's response, Mr. Alexander petitioned this office and SPR19/1459 was issued as a result. In my September 13, 2019, determination, I found upon in camera review of the responsive records, the responsive records may fall within an exemption under the Public Records Law. Please refer to the determination in SPRl 9/1459 for analysis of this issue. Following my finidng that the School may assess a reasonable fee for the cost of segregating and/or redacting the records, Mr. Alexander requested to inspect the records subject to the in camera review. Attorney Fried SPR19/1919 Page 2 September 27, 2019 Conclusion Based on a review of previous determinations, I find it uneccessary to opine on the School's petition, as it has been previously determined they may asses a reasonable fee for segregation and/or redaction for the requested records. See SPRl 9/13 50 Determination of the Supervisor of Records (July 12, 2019); and SPR19/1459 Determination of the Supervisor of Records (September 13, 2019). Please note, the requestor has the right to seek judicial review of this decision by commencing a civil action in the appropriate superior court. See G. L. c. 66, § 10(d)(iv)(4), lOA(c).
