Silvia Department of Correction 50 Maple Street, Suite 3 Milford, MA 01757 Dear Kate Silvia: I have received the petition of John Diaz appealing the nomesponse of the Department of Correction (Department) to his requests for public records. G. L. c. 66, § 1 OA; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Diaz requested the "Department of Correction special investigator job description and the designated person responsible for clearing inmate security clearances." Claiming to not yet have received a response, Mr. Diaz petitioned this office and this appeal, SPR19/1928, was opened as a result. Despite being notified of the opening of this appeal and communication from a staff member of the Public Records Division, it remains unclear whether the Department has provided a response. As such, the Department is ordered to provide Mr. Diaz with a written response. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Diaz may appeal the substantive nature of the Department's response within ninety days.
