Wong City of Boston - Fire Department 115 Southampton Street Boston, MA 02118 Dear Ms. Wong: I have received the petition of Yisbert Lara appealing the nonresponse of the Boston Fire Department (Department) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Lara requested "a copy of all Reports, Photographs, Lab Results, Opinions, Interviews, Statements, Video Tapes, Audio, E-mails, Incident Reports, Investigative Reports, and any other documents relevant to incident #03/35683 at the Boston Police Headquarters at Schroeder Plaza to conduct a cause and origin of a fire investigation on dated June 27, 2003." Claiming to not yet have received a response, Mr. Lara petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department will respond to Mr. Lara's request. Whereas the basis of this appeal was opened as a result of the Department's initial nonresponse according to Mr. Lara, I will now consider this administrative appeal closed. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Lara may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1).
