Dear Ms. J oyce:

I have received the petition of Eric Helfer appealing the nonresponse of the Holbrook Planning Board (Board) to a request for public records. G. L. c. 66, § 10A; see also 950 C.MLR. 32.08(1). Specifically, Mr. Helfer requested “Form A (ANR) approval and all related documents that was submitted on August 21, 2019. In addition, a request to be placed on the Holbrook: ~ Planning Board’s agenda for a subdivision plan by Gioioso Bros Inc. and all submitted documents”. Claiming to not yet have received a response, Mr. Helfer petitioned this office and this appeal was opened as a result.

Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Board responded to Mr. Helfer’s request with a response sent on September 26, 2019 as well as September 30, 2019. Whereas this appeal was opened as a result of the Board’s failure to provide a written response, I will now consider this administrative appeal closed. I understand Mr. Helfer appealed the response from September 30, 2019 on October 1, 2019. This office has opened a new appeal, SPR19/2074, té address the issues Mr. Helfer raises in his October 1st appeal.
