G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Holmes requested "any and all information regarding the number of 40R units required in the city of Brockton under the SMART Growth law." Claiming to not yet have received the responsive records, Ms. Holmes petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Depaiiment intends on proving the requested records. In light of the Department's intention to provide the responsive records, I will now consider this administrative appeal closed.
