The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray S11pe11>isor of Records October 23, 2019 SPR19/2064 L01Taine Rousseau, Esq. Bristol County Sheriffs Office 400 Faunce Corner Road North Dartmouth, MA 02747 Dear Attorney Rousseau: I have received the petition of Caroline Milosevich appealing the nonresponse of the Bristol County Sheriffs Depaiiment (Depatiment) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Ms. Milosevich requested "documents that show the number of immigrant detainees currently being held by the Suffolk County Sheriffs Department on behalf of Immigration and Customs Enforcement (ICE), any documents showing the Average Daily Population for the period from August 1, 2018 to the present, and any documents showing the amount of compensation the jail receives per detainee per night and total revenue from August 1, 2018 to the present" including " any documents, like invoices, that indicate the amount of payment due to the Suffolk County Sheriffs Department from ICE or the Department of Homeland Security (OHS) from August 1, 2018 to the present." Subsequent to the intervention by a member of the Public Records Division, it is my understanding that the Depaiiment is aware of this appeal and is working on a response. As of the date of this letter, the Department has not provided Ms. Milosevich a response to her request for records. · Order Accordingly, the Depaiiment is ordered to provide Ms. Milosevich with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations without delay. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Milosevich may appeal the substantive nature of the Depaiiment's response within ninety days. See 950 C.M.R. 32.08(1).
