G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Helfer requested "Form A (ANR) approval and all related documents that was submitted on August 21, 2019. In addition, a request to be placed on the Holbrook Planning Board's agenda for a subdivision plan by Gioioso Bros Inc. and all submitted documents" that is within possession of the Office. Claiming to not yet have received a response, Mr. Helfer petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Board responded to Mr. Heifer's request with a response sent on October 10, 2019. Whereas the basis of this appeal was opened as a result of the Board's lack ofresponse, I will now consider this administrative appeal closed. Mr. Helfer may appeal the substantive nature of the Board's response within ninety (90) days. See 950 C.M.R. 32.08(1).
