Dear Attorney Thompson:

I have received the petition of Donald Hall appealing the response of the City of Worcester (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Hall requested several categories of records within the possession of the City. Claiming to not yet have received a response, Mr. Hall petitioned this office and this appeal was opened as a result.

Subsequent to the intervention by a staff member of the Public Records Division, I learned that the City responded to Mr. Hall’s request with responses sent on September 10 and 11, 2019. Furthermore, the responses will be resent to Mr. Hall in another mailing to ensure he has all records within the City’s control. Whereas the basis of this appeal was opened as a result of the City’s lack of response, I will now consider this administrative appeal closed. Mr. Hall may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
