Dear Ms. Stone:

I have received the petition of Maurice Felder appealing the nonresponse of the City of Springfield — Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically on September 15, 2019, Mr. Felder made a public records request for the following materials:

A) “Any and all investigative report and logs relative to the above murders on Tyrone ‘Tee Jay’ Lewis, and Adrian White that took place on February 6", 2005.

B) Any and all documents that implicate Maurice Felder as it relates to the murders of Tyrone ‘Tee Jay’ Lewis and Adrian White;

C) Any and all logs, memos, status report, or police reports as it relates of deal with the murders of Tyrone ‘Tee Jay’ Lewis and Adrian White,

D) Any and all material that is associated with the investigation into the murders of Tyrone ‘Tee Jay’ Lewis and Adrian White, including medical reports, doctor logs and notes, and relevant arrest sheets regarding Maurice Felder;

E) Any and all outside agency help/assistance into the murders of Tyrone ‘Tee Jay’ Lewis and Adrian White;

F) Any and all money that was logged, found or discovered as it relates to the investigation into this case.

G) All officers that investigated the case, their incident reports, forms and notes that. were a part of this investigation;

H) Any and all test conducted by your agency, an outside agency, including finger prints analysis, phone records, logs and memo, including individuals talked to in regards to the above mentioned murders of Mr. Lewis and Mr, White.”

Claiming to not yet have received responsive records, Mr. Felder petitioned this office and this appeal was opened as a result.

Conclusion

Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department has yet to respond to Mr. Felder’s request. Accordingly, the Department is ordered to provide Mr. Felder with a response consistent with the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Felder may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
