Dear Attorney Skinner:

I have received the petition of Brian Keaney appealing the nonresponse of the Massachusetts Bay Transportation Authority (Authority) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32,08(1). Specifically, Mr. Keaney requested the police report for the incident that occurred at Endicott Station in Dedham on October 14" from the Authority, Claiming to not yet have received a response, Mr. Keaney petitioned this office and this appeal was opened as a result.

Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Authority responded to Mr. Keaney’s request with a response sent on November 1, 2019. Whereas the basis of this appeal was opened as a result of the Authority’s lack of response, I will now consider this administrative appeal closed. Mr. Keaney may appeal the substantive nature of the Authority’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
