Dear Ms. Duplin:

I have received the petition of Stevan Johnson appealing the nonresponse of the Swampscott Town Clerk’s Office (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Johnson requested “any records in the possession, custody, or control within the City or Town relative to the newspaper publication of: (i) ordinances or bylaws and/or (ii) rules and orders for the regulation of carriages and vehicles used therein for the conveyance of persons from place to place for hire.” Claiming to not yet have received a response, Mr. Johnson petitioned this office and this appeal was opened as a result.

Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Office responded to Mr. Johnson’s request with a response sent on November 5, 2019. Whereas the basis of this appeal was opened as a result of the Office’s lack of response to Mr, Johnson’s request, I will now consider this administrative appeal closed. Mr. Johnson may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
