Dear Attorney Miltimore:

I have received the petition of Gregory Smith appealing the nonresponse of the Cape and Islands District Attorney’s Office (DAO) to a request for public records. G. L. c: 66, § 10A; see also 950 C.MLR. 32.08(1). Specifically, Mr. Smith requested “contact information” regarding a complete list of the official individual email addresses for all Assistant District Attorney employees at the Cape and Islands District Attorney’s Office. In addition, Mr. Smith requested additional records in this appeal including:

a) A complete list of the official individual email addresses for all Cape & Islands ADAs. .

b) Police training materials and all related documents as they are created and used

concerning training sessions for the three year period going forward from September 23, 2019.

c) Information concerning the identity of the ADA that represented the Commonwealth in a hearing related to Commonwealth v. Gregory Smith on Match 30, 2017.

Unsatisfied with the nonresponse from the DAO, Mr. Smith petitioned this office and this appeal was opened as a result.

Previous Determination

This request was the subject of a previous determination, SPR19/1933. See SPR19/1933 Determination of the Supervisor of Records (October 3, 2019). In the October 3, 2019 determination, “Mr. Smith sent a request to the DAO seeking records concerning ‘contact information.’” The DAO responded to Mr. Smith on August 28, 2019, Mr. Smith appealed the DAO’s response to this office on September 22, 2019.

Conclusion

Subsequent to the intervention by a staff member of the Public Records Division, I learned the DAO responded to the request in a letter dated on November 19, 2019.

Whereas the basis of this appeal was opened as a result of the DAO’s lack of response to Mr. Smith’s request, I will now consider this administrative appeal closed. Mr. Smith may appeal the substantive nature of the DAO’s response within ninety (90) days. See 950 C.M.LR. 32.08(1).
