City Solicitor City of Marlborough City Hall, 4111 Floor 140 Main Street Marlborough, MA 01752 Dear Attorney Grossfield: I have received the petition of Attorney Eliza Lockhart-Jenks of the Committee for Public Counsel Services appealing the response of the City of Marlborough (City) to a request for public records. G. L. c. 66, § IOA; see also 950 C.M.R. 32.08(1). Specifically, Attorney Lockhati-Jenks requested information regarding incidents occurring at Charles Whitcomb School. The City responded on August 28, 2019, providing some responsive records and withholding others pursuant to Exemptions (a) and (c) of the Public Records Law. Subsequent to the intervention of a member of the Public Records Division, I learned that the City intends to provide a supplemental response including additional responsive records. Accordingly, the Department is ordered to provide Attorney Lockhart-Jenks with said response within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. If issues remain outstanding, Attorney Lockhart-Jenks may appeal the substantive nature of the City's response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
