Massachusetts Department of Transportation 10 Park Plaza, Suite 3910 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Chris Dwan appealing the nonresponse of the Massachusetts Depaiiment of Transportation (Department) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Dwan requested "[a]l performance evaluations of Newpmi Construction between 2010 and the present. This includes but is not limited to the 'contractor project evaluation forms.' Documentation of any complaints filed against Newpmi Constrnction, and records of any disciplinary or corrective actions taken as a result of those complaints." Subsequent to the intervention by a member of the Public Records Division, I learned that the Department provided Mr. Dwan a response to his request. Accordingly, I will now consider this administrative appeal closed. Mr. Dwan may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1).
