The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray S11pe111isor ofR ecords December 6, 2019 SPR19/2348 Kate M. Silvia Department of Correction 50 Maple Street Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Attorney David Milton appealing the nonresponse of Department of Correction (Department) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, Attorney Milton requested "the written decision of the Commisioner on all medical parole petitions received to date" and "documents sufficient to identify the name, court, and docket number of all actions of any type challenging the Commissioner's decision on a medical parole petition or otherwise challenging the Department's actions in response to a medical parole petition." Subsequent to the intervention by a member of the Public Records Division staff, the Department provided Attorney Milton a response November 27, 2019. Whereas this matter was opened based upon the lack of a written response to the request, I will now consider this administrative appeal closed. Attorney Milton may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, ~~ Rebecca S.
