The Commonwealth of Massachusetts | William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S, Murray Supervisor of Records December 19, 2019 SPR19/2425 Attorney Tara Miltimore Cape and Islands District Attorney’s Office 3231 Main Street, P.O. Box 455 Barnstable, MA 02630 Dear Attorney Miltimore: I have received the petition of Gregory Smith appealing the response of the Cape and Islands District Attorney’s Office (DAO) to a request for public records, G. L..c. 66, § 10A; see also 950 C.MLR. 32.08(1). Specifically, on September 23, 2019, Mr. Smith requested records of the “individual official email addresses for all Cape and Islands ADAs.” Unsatisfied with the response from the DAO issued on November 19, 2019, Mr. Smith petitioned this office and this appeal was opened as a result. Previous Determination This request was the subject of a previous determination. See SPR19/2237 Determination of the Supervisor of Records (November 19, 2019). In the November 19, 2019 Determination, a representative from the DAO responded to the request Mr. Smith filed in a letter dated on November 19, 2019. Previous Appeal In a letter dated November 19, 2019, the DAO in response to Mr, Smith’s request states, “contact information for the Cape and Islands District Attorney’s Office have previously been provided. No other responsive records are available to Mr. Smith’s request.” Current Appeal In an email dated December 5, 2019, Mr. Smith states the final element of the “contact information request” regarding the email addresses has not been provided by the DAO. Mr. Smith may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.LR. 32.08(1). Lorna Labecca. S. Murray q Supervisor of Records ce: Mr, Gregory Smith
