G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, on November 22, 2019, Mr. Russell requested " ... investigatory reports that resulted in a fire Dec. 8, 2011 ... ai1d a fire Dec. 9, 2018" in Worcester. In an email dated December 9, 2019, the City provided Mr. Russell a response. Unsatisfied with the City's response, Mr. Russell petitioned this office and as a result SPRl 9/2445 was opened. · Based on a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Mr. Russell. Accordingly, the City is ordered to provide Mr. Russell with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Russell may appeal the substantive nature of the City's response within ninety days. See 950 C.M.R. 32.08(1).
