G. L. c. 66, § 1O A; also 950 C.M.R 32.08(1). Specifically, on November 13, 2019, Mr. DeFraia requested the following records within the Department: 1. Data showing the number of U visas the BPD has provided and denied since 2000. 2. Copies of any policies or procedures that outline the BPD's process in reviewing U visa certification requests. 3. Copies of any and all Supplement B (U visa certification) forms, and accompanying attachments, including but not limited to, police reports and any other investigative records, approved by the agency in 2018. 4. Copies of any and all Supplement B (U visa certification) forms, and accompanying attachments, including but not limited to, police reports and any other investigative records, denied by the agency in 2018. Claiming to not yet have received responsive records, Mr. DeFraia petitioned this office and this appeal was opened as a result. Accordingly, the Depaiiment is ordered to provide Mr. DeFraia with said response in compliance with the Public Records Law and its Access Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. DeFraia may appeal the substantive nature of the Department's response within ninety (90) days.
