LeFever New Bedford Police Department 871 Rockdale Avenue New Bedford, MA 02740 Dear Ms. LeFever: I have received the petition of Attorney Chris Lindberg appealing the response of the City of New Bedford Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R, 32.08(1). Specifically, on December 16, 2019, Attorney Lindberg requested a copy of certain records relating to a certain motor vehicle accident. Claiming to not yet have received responsive records, Attorney Lindberg petitioned this office and this appeal was opened as a result. Current Appeal In an email dated December 18, 2019, Attorney Lindberg claims the request for information was denied. “The Records Access Officer simply wrote in pen on the request denying our request for the information, never citing:a specific exemption and how that information fell within that specific exemption.” Subsequent to the intervention by a staff member of the Public Records Division, I learned the City affirmed that they will work in collaboration with the Department and intends on providing a response. Conclusion Accordingly, the City is ordered to provide the response in compliance with the Public Records Law and Access Regulations within ten (10) business days, It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Lindberg may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
