Young Amherst Police Depaiiment 111 Main Street Amherst, MA O1 002 Dear Captain Young: I have received the petition of Vira D. Cage appealing the response of Amherst Police Department (Department) to a request for public records. G. L. c. 66, § 1 OA; see also 950 C.M.R. 32.08(1). This request was the subject of a previous appeal. See SPR19/2327 Determination of the Supervisor of Records (December 2, 2019). In my December 2nd determination I indicated that the Department must provide a response to Ms. Cage in a manner consistent with the order, the Public Records Law, and its Regulations. The Department provided Ms. Cage a response on December 13, 2019. Unsatisfied with the Depaiiment's response, Ms. Cage petitioned this office and as a result SPRl 9/2517 was opened. Based on a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Depaiiment intends on providing a subsequent response to Ms. Cage Accordingly, the Department is ordered to provide Ms. Cage with a response to her reqllest in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to serid an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Cage may appeal the substantive nature of the Department's response within ninety days.
