Staples Chief Legal Counsel Department of Massachusetts State Police 4 70 Worcester Road Framingham, MA 01702 Dear Attorney Staples: I have received the petition of Michael Hayes appealing the nonresponse of the Department of Massachusetts State Police (Department) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, on November 25, 2019, Mr. Hayes requested the following records related to the "Massachusetts State Police's use of the Boston Dynamics Spot Robot ("Spot")." • Purchase Records and Agreements: Any and all records reflecting an agreement for purchase, acquisition, or license of "Spot," or permission to use, test, or evaluate "Spot" since January 1, 2019. • Records of Use: Any and all records describing the Massachusetts State Police's use of "Spot" since January 1, 2019. Claiming to not yet have received responsive records, Mr. Hayes petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department intends on providing a written response to Mr. Hayes. Accordingly, the Department is ordered to provide Mr. Hayes with a response in accordance with the Public Records Law, its Access Regulations and this order within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Hayes may appeal the substantive nature of the Department's response within ninety (90) days.
