Murray Supervisor ofR ecords January 22, 2020 SPR20/0026 Ines da Silva Paulino Leite City of Fall River Office of the City Clerk One Government Center Room227 Fall River, MA 02722 Dear Ms. Leite: I have received the petition of Patrick Higgins appealing the response of the City of Fall River - Office of the City Clerk (City) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, on December 15, 2019, Mr. Higgins requested the following records regarding "a copy of the written opinion of Judge William T. Carey and Judge George Jacobs in the Patrick Higgins v. Charlene Simcock from the 1980s." Current Appeal In response to Mr. Higgins' request, the City replied on January 6, 2020 stating "a search was conducted of the records on file in the Law Department and the Traffic and Parking Division and no responsive records were found to be on file." Unsatisfied with this response provided by the City, Mr. Higgins petitioned this office and this appeal was opened as a result. Co11clusio11 Subsequent to the intervention by a staff member of the Public Records Division, I learned that the City responded to Mr. Higgins' request with a response sent on January 22, 2020. Consequently, I will consider this administrative appeal closed. Mr. Higgins may appeal the substantive nature of the City's response within ninety (90) days. See 950 C.M.R. 32.08(1).
