Murray Supervisor ofR ecords January 28, 2020 SPR20/0062 Joshua Martunas Staff Assistant & Records Access Officer City of Worcester Office of the City Manager 455 Main Street Worcester, MA 01608 Dear Mr. Martunas: I have received the petition of Gerard Russell of the Telegram & Gazette appealing the response of City of Worcester (City) to & request for public records. G. L. c. 66, § lOA; also 950 C.M.R. 32.08(1). Specifically on November 22, 2019, Mr. Russell requested " ... investigatory reports that resulted in a fire Dec. 8, 2011 ... and a fire Dec. 9, 2018" in Worcester. Previous appeal This request was the subject of a previous appeal. See SPRl 9/2445 Determination of the Supervisor of Records (December 19, 2019). I closed SPR19/2445 by ordering the City to provide Mr. Russell with a supplemental response to the request, provided in a manner consistent with the Public Records Law and its Regulations. In a response dated January 6, 2020 the City provided a supplemental response to Mr. Russell. Unsatisfied with the City's response, Mr. Russell appealed and SPR20/0062 was opened as a result. Based on a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Mr. Russell addressing his concerns. Accordingly, the City is ordered to provide Mr. Russell with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send .an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Russell may appeal the substantive nature of the City's response within ninety days.
