Scanlan Executive Office of Health and Human Services One Ashburton Place Room #1109 Boston, MA 02108 Dear Ms. Scanlan: I have received the petition of Ramona Lane appealing the nonresponse of the Executive Office of Health and Human Services (EOHHS) to a request for public records. G. L. c. 66, § lOA; see 950 C.M.R. 32.08(1). Specifically, on two separate occasions, December 16, 2019 and December 20, 2019, Ms. Lane requested the following records within the EOHHS: • My payment remittance forms for the entire month of April 2019 • All personal records involving audits, overpayments and recoupments since 2015. Claiming to not yet have received responsive records, Ms. Lane petitioned this office and this appeal, SPR20/0100, was opened as a result. Based upon a conversation between a Public Records Division staff member and a representative from EOHHS on January 31, 2020, it is my understanding that EOHHS intends on providing a supplemental response to Ms. Lane in regards to her public records request. Accordingly, EOHHS is ordered to provide Ms. Lane with said response within ten (10) business days in compliance with the Public Records Law and Access Regulations. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Lane may appeal the substantive nature of EOHHS's response within ninety (90) days. See 950 C.M.R. 32.08(1).
