Belair appealing the nonresponse of the Boston Police Department (Department) to a request for public records. G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, on November 12, 2019, Attorney Belair requested "records of any and all police reports concerning altercations, disturbances or any other events resulting in a police response from January 1, 2013 to the present time" at the "Boston Beer Garden." Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within 10 business days ofreceipt of the request. G. L. c. 66, § IO(a)-(b). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L. c. 66, § IO(b). All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. It is my understanding that a member of the Public Records Division staff has been in contact with the Department. They indicated a response will be provided to Attorney Belair, but as of this date a response has not been provided. Order Accordingly, the Depaiiment is ordered to provide Attorney Belair with a response to the · request, provided in a manner consistent with this order, the Public Records Law, and its Regulations without delay.
