Purple Town Administrator Town of Southborough 17 Common Street Southborough, MA O1 7 72 Dear Mr. Purple: I have received the petition of Carl Guyer appealing the response of the Town of Southborough (Town) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, on September 26, 2019, Mr. Guyer requested "historical documents from the Board of Selectmen, Board of Health and the Conservation Commission related to actions and decisions made regarding the commercial dump/landfill still in existence on the town own[ ed] property referred to as the Breakneck Hill conservation land." Previous appeals This request was the subject of a previous appeals. SPRl 9/2246 Determination of the Supervisor of Records (November 18, 2019); See SPRl 9/2516 Determination of the Supervisor of Records (January 8, 2020). Unsatisfied with the Town's responses, Mr. Guyer petitioned this office and as a result, SPR20/0141 was opened. Based on a conversation between a Public Records Division staff attorney and a Town representative, it is my understanding that the Town intends on providing a subsequent response to Mr. Guyer to address his concerns. Accordingly, the Town is ordered to provide Mr. Guyer with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Guyer may appeal the substantive nature of the Town's response within ninety days. 950 C.M.R. 32.08(1).
