The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor ofR ecords February 10, 2020 SPR20/0149 Ms. Claudia Buruca Suffolk County District Attorney's Office One Bulfinch Place Suite 300 Boston, MA 02114 Dear Ms. Buruca: I have received the petition of Kevin Rothstein appealing the nonresponse of the Suffolk County District Attorney's Office (Office) to a request for public records. G. L. c. 66, § lOA; see also 950 C.M.R. 32.08(1). Specifically, on October 15, 2020, Mr. Rothstein requested "an electronic copy of portions of the Office's ('DAMION') or similar database containing criminal case information in that the Office provide a number of categories from the case database, where such records were created since January 1, 2019 through the time this public records request is fulfilled." Claiming to not yet have received responsive records, Mr. Rothstein petitioned this office and this appeal, SPR20/0149, was opened as a result. Current Appeal Mr. Rothstein, in a letter to our office on January 22, 2020, claims the Office ''has supplied this very same data for prior years." A representative from the Office indicated in an email dated on January 7, 2020 to Mr. Rothstein that the records should be released on the week of January 13th. There have been no further responses between the Office and the requestor in regards to Mr. Rothstein's filed request. Conclusion Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Office responded to Mr. Rothstein's request and provided the responsive materials in electronic format on February 7, 2020.
