G. L. c. 66, § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Ms. Carey requested "any and all documents indicating the exact locations of every currently broken or malfunctioning fire hydrant in the Town of Hull including such hydrants to be repaired/replaced by Aquarion Water." The Public Records Access Regulations, which govern the procedural aspects of all appeals, require that an appeal to this office be filed within ninety days of the date of the request letter, or within ninety days of the date of a written response from the record custodian. 950 C.M.R. 32.08(l)(d); 950 C.M.R. 32.08(l)(e). Upon review of the file, it appears that the · Department's response was sent on May 23, 2019. Accordingly, it has exceeded the ninety day limit. Ms. Carey may make a new request to the Department for the same information. The Department will have ten business days in which to respond to a new request. G. L. c. 66, § lO(b). If the Department denies a request or fails to respond within ten business days, an appeal may be filed with this office within the statutory time frame.
