Dear Ms. Wong:

I have received the petition of Matthew Rocheleau appealing the nonresponse of the City of Boston Fire Department (Department) to a request for public records. G. L, c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on December 30, 2019, Mr. Rocheleau requested the following records: “Any/all Boston Fire Department reports and any/all logs of calls and responses for an incident that occurred at about 9:45 AM on December 28, 2019 in Copley Square...”

Claiming to not yet have received responsive records, Mr. Rocheleau petitioned this office and this appeal, SPR20/0241, was opened as a result.

Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department has yet to respond to Mr. Rocheleau’s request. Accordingly, the Department is ordered to provide Mr. Rocheleau with said response within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Rocheleau may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
