G. L. c. 66, § lO(A); see also 950 C.M.R. 32.08(1). Specifically, Mr. Johnson requested "a copy of each and every (a) Toll Violation Notice or (b) Pay By Plate Invoice, if any, issued to each and every member of the Boston Cab cartel pursuant to Massachusetts Code of Regulations 700 CMR 7.00-7.12 et seq. between October 1, 2016 and December 31, 2016 regarding toll charges incurred by any paiiicular member of the cartel; and (iii) a copy of any (a) Toll Violation Notice or (b) Pay By Plate Invoice, if any, issued to EJT Management, Inc. ('EJT') pursuant to Massachusetts Code of Regulations 700 CMR 7.00-7.12 et seq. between October 1, 2006 and December 31, 2019 regarding toll charges incurred by EJT. '' Subsequent to the intervention by a staff member of the Public Records Division, I learned the Depaiiment provided Mr. Johnson with a response on February 10, 2020. In light of the Department's response, I will now consider this administrative appeal closed. Mr. Johnson may appeal the substantive nature of the Department's response within ninety days.
