Dear Attorney Moeser:

I have received the petition of Professor Maggie Mulvihill appealing the response of the City of Lowell (City) to a request for public records, G. L. c. 66, § 10A; see also 950 C.MLR. 32.08(1). Specifically, Professor Mulvihill requested “...access to and copies of all records relating to calls to the city from residents with a non-emergency concern or complaint including but not limited to the date of the call, the address of the caller and the nature or description of the call ... from Jan, 1, 2015 to present.”

Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Professor Mulvihill to address the concerns raised in the appeal.

Accordingly, the City is ordered to provide Professor Mulvihill with a response to her request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Professor Mulvihill may appeal the substantive nature of the City's response | within ninety days. See 950 C.MLR. 32,08(1).
